FluxCapacity.io is a marketplace platform that connects companies with fractional CTOs and technology leaders. Our Service includes:

• Profile creation and management
• Matching and discovery tools
• Video conferencing capabilities
• Messaging and collaboration features
• Payment processing and invoicing
• Session tracking and management

3. User Accounts

To use our Service, you must:

• Be at least 18 years old
• Provide accurate and complete information
• Maintain the security of your account credentials
• Promptly update your account information
• Be responsible for all activities under your account

4. Company Responsibilities

Companies using our platform agree to:

• Provide accurate company and project information
• Pay for services as agreed through our platform
• Treat CTOs professionally and respectfully
• Comply with applicable employment and contractor laws
• Not misuse CTO contact information or intellectual property

5. CTO Responsibilities

CTOs using our platform agree to:

• Provide accurate professional credentials and experience
• Deliver services professionally and on time
• Maintain confidentiality of client information
• Submit to background verification if required
• Pay applicable platform fees and commissions

7. Intellectual Property

All content on FluxCapacity.io, including text, graphics, logos, and software, is the property of FluxCapacity or its content suppliers. User-generated content remains the property of the user, but you grant us a license to use it in connection with the Service.

8. Prohibited Activities

You may not:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Transmit malicious code or viruses
• Circumvent platform fees by contracting directly
• Harass, abuse, or harm other users
• Impersonate others or provide false information
• Scrape or harvest user data

9. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted access. We may suspend or terminate the Service for maintenance, updates, or security reasons with reasonable notice when possible.

10. Termination

We reserve the right to suspend or terminate your account for violation of these terms. You may cancel your account at any time through your settings. Upon termination, you remain liable for any outstanding payments.

11. Limitation of Liability

FluxCapacity.io is a marketplace platform. We facilitate connections but are not party to agreements between companies and CTOs. We are not liable for the quality of services, payment disputes, or damages arising from engagements. Our liability is limited to the amount you paid us in the preceding 12 months.

12. Dispute Resolution

Any disputes arising from these terms will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive the right to participate in class actions.

13. Indemnification

You agree to indemnify and hold harmless FluxCapacity.io from any claims, damages, or expenses arising from your use of the Service or violation of these terms.

14. Changes to Terms

We may modify these terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance.

15. Governing Law

These terms are governed by the laws of the State of Delaware, without regard to conflict of law provisions.
